Judges Tosses Evidence in Nowack Case

The Associated Press reported that much of the evidence against Lisa Nowack must be thrown out, including her six-hour interview and items found in her BMW.
Investigators took advantage of 44-year-old Lisa Nowak, who had not slept for more than 24 hours, coercing her into giving information in a lengthy arrest interview, Orange County Circuit Judge Marc L. Lubet said.

Lubet granted a defense motion to throw out comments she made during the six-hour interview and items seized during a search of her BMW, including maps to alleged victim Colleen Shipman's home, large garbage bags, latex gloves and some soiled toddler-sized diapers.

...The ruling was a big win for the defense. But evidence from a duffel bag Nowak was carrying — a steel mallet, buck knife, BB gun resembling a real 9mm handgun, gloves and six feet of rubber tubing — remains in the case.

What? They won't admit the diapers? I'd think that would help the defense if they plead insanity. In any event, although this case has its amusing aspects, based on the contents of her bag I shudder to consider what might have happened if the alleged abduction attempt had been successful.

I sincerely doubt that this case will go to trial. Last week's decision reinforces my conviction that a plea bargain will be reached that does not involve any time behind bars.

I don't think jail is necessary as punishment in this case. Lisa's life is shambles. Her Astronaut career is obviously over, but so is any Navy career. She's a laughing stock who is unlikely to ever be given a position of trust or responsiblity again.

Regardless of the trial or plea bargain, the outlook for Lisa is dim.
